The Legal Standard in Pakistan

Under the Guardians and Wards Act 1890, Pakistani courts apply the "welfare of the minor" as the paramount consideration. In practice, young children — especially girls up to approximately age seven — generally remain with the mother (hizanat) under Hanafi personal law. After this age the father's claim strengthens. Courts consider income, stability, the child's own wishes (if sufficiently mature) and all relevant circumstances.

Emergency Custody — Child Abduction

If a parent has taken a child without consent or is threatening to leave Pakistan, we obtain an Exit Control Order (ECO) on an emergency basis — the same day if required. An ECO prevents the child from leaving the country. For children already taken abroad, the Hague Convention procedures apply in member states.

Guardianship Certificates for NADRA

Following the death of a father, the surviving parent or closest relative needs a court-issued guardian certificate to process a child's NADRA documents. We complete the guardian court petition through to NADRA submission in 4–6 weeks.

Under Hanafi personal law, a mother's hizanat (custody) may be affected if she remarries a person who is not a mahram relative of the child.
