Rent & Tenant Eviction Lawyer in Karachi
Eviction and rent recovery before the Rent Controller in Karachi — residential and commercial.
Eviction through the Rent Controller
Landlord-tenant disputes over rented residential and commercial premises in Karachi are governed by the Sindh Rented Premises Ordinance, 1979, and decided by the Rent Controller Court. A landlord cannot lock a tenant out, cut utilities or remove belongings without a court order — self-help eviction is illegal and can lead to a criminal complaint and an injunction reinstating the tenant. We take the legal route: notice, application, order and execution.
Grounds for eviction
- Non-payment of rent
- Expiry of the lease or tenancy period
- The landlord's bona fide personal need
- Sub-letting without the landlord's consent
- Damage to the property or nuisance
- Breach of the conditions of tenancy
How an eviction case runs
- Legal notice — stating the ground and giving the tenant a period to remedy it or vacate.
- Eviction application — filed with the Rent Controller where the property is located, with the tenancy agreement and any claim for arrears.
- Notice to the tenant — the court calls the tenant to appear and respond.
- Hearing and order — in non-payment cases the tenant may be given a chance to pay the arrears first.
- Execution — the physical eviction is carried out with court bailiff support and, if needed, police assistance.
- Rent arrears — recovered through the Rent Controller's order or a separate civil suit, depending on the amount and circumstances.
No written tenancy agreement?
Oral tenancies are recognised. The relationship and the default can be proved with rent receipts, utility records and witnesses — though a signed written agreement makes the case much clearer. For new tenancies, see rent agreement drafting.
