Islamic Inheritance Distribution

Partition Suits

Where heirs cannot agree on the division or sale of inherited property, we file a partition suit (taqseem) in the civil court. The court appoints a commissioner, values the property and orders equitable division or sale, distributing proceeds according to the correct shares.

Challenging Fraudulent Transfers

If a co-heir has fraudulently transferred inherited property to themselves — through forged documents or misrepresentation — we file a declaration suit to void the transfer and an FIR for forgery under Sections 420, 468 and 471 PPC. Both tracks are pursued simultaneously.

Will (Wasiyat) Challenges

Under Muslim Personal Law, a will is only valid for up to one-third of the estate. Any bequest that exceeds one-third and prejudices the remaining heirs can be challenged in court and reduced to the permissible maximum.
