Key points
- •A Special Power of Attorney lets your lawyer file and pursue the case in Karachi.
- •Courts may allow your statement by video link; we tell you in advance if you are needed.
- •The Union Council's 90-day process follows the decree before the certificate is issued.
- •A Pakistani khula decree is not automatically recognised abroad.
How do I file for khula from abroad?
- 1
Give a Special Power of Attorney
Attest it at a Pakistani mission or through NADRA so your lawyer can file and appear.
- 2
Send your documents
Nikah nama, CNIC/NICOP, and details of dower, maintenance and any children.
- 3
File in the right family court
We file where you last resided or where the parties last lived together, as the rules allow.
- 4
Attend key hearings remotely where allowed
Courts may permit your statement by video link. We arrange it in advance.
- 5
Complete the Union Council step
After the decree, the Union Council process runs for 90 days before the divorce certificate is issued.
Will my khula be valid in the country where I live?
Recognition depends on that country's law. In England and Wales it is decided under the Family Law Act 1986, and Pakistani khula decrees have been challenged — for example in Q v Q [2025] EWFC 192 (B). If you plan to remarry or bring a financial claim abroad, take local advice as well. We provide certified copies of the Pakistani decree and certificate.
What about custody, dower and maintenance?
Claims for dower, maintenance and custody can be filed alongside or after the khula. Custody is decided on the child's welfare, and a child living abroad raises extra questions about jurisdiction. We advise on the order of filings so one claim doesn't weaken another.
