Constitutional petitions under Article 199 against unlawful orders of government departments and public authorities.
Kharal Law Associates, Karachi, files constitutional (writ) petitions under Article 199 of the Constitution before the Sindh High Court against unlawful orders of government departments and public authorities — including FIA offloading and stop-list matters.
When a writ petition is the right remedy
A writ petition is for a person affected by an unlawful order, or a failure to act, by a government department, public authority or statutory body — for example an FIA offloading or stop-list decision, a NADRA block, a KDA or SBCA order, or a university admission or result.
The writs under Article 199
- Mandamus and prohibition — Article 199(1)(a)(i): directing an authority to do what the law requires, or to stop doing what it does not permit.
- Certiorari — Article 199(1)(a)(ii): declaring an order made without lawful authority to be of no legal effect.
- Habeas corpus — Article 199(1)(b)(i): production of a person held in custody.
- Quo warranto — Article 199(1)(b)(ii): requiring a person holding public office to show the authority under which they hold it.
When a writ is not available
- Private disputes between individuals
- Where an adequate alternate remedy — an appeal or a tribunal — exists
- Where the facts are seriously disputed and need evidence
- Terms of service of civil servants, which go to the Service Tribunal under Article 212 — see service matters
How a writ petition runs
- Case review — is there an adequate alternate remedy?
- Representation — a notice to the department, to build the record.
- Drafting — memo of petition, affidavit and stay application.
- Filing — office objections, then the first hearing.
- Notice and comments — the respondents file comments; hearing and order. If the order is not obeyed, a contempt application.
Documents
- CNIC
- The impugned order, letter or notice
- Correspondence with the department and proof of receipt
- Related record — appointment letter, allotment, result card, and so on

In private disputes, where an adequate appeal or tribunal remedy exists, where the facts are seriously disputed and need evidence, and in civil servants' terms of service, which go to the Service Tribunal under Article 212.
There is no fixed limitation period, but a petition can be dismissed for delay (laches) — file promptly.
An application for an interim order is made at the first hearing; whether it is granted is in the court's discretion.
Yes. Offloading is an administrative action, and the Sindh High Court hears it in its writ jurisdiction.
